Oktober 2024 hat der Gerichtshof der <a href=\"https:\/\/regask.com\/de\/eu-general-court-annuls-regulation-classifying-titanium-dioxide-as-carcinogenic\/\">europ\u00e4ische Union<\/a> Das Gericht hat ein wichtiges Urteil zur Verwendung von Begriffen, die traditionell mit tierischen Produkten in Verbindung gebracht werden, f\u00fcr Lebensmittel mit pflanzlichen Proteinen gef\u00e4llt. Dieses Urteil hat wichtige Auswirkungen auf die Auslegung und Anwendung der Verordnung (EU) Nr. 1169\/2011 zur Lebensmittelkennzeichnung.<\/p>\n<p>In Frankreich fochten mehrere Branchenverb\u00e4nde des vegetarischen Produktsektors ein Dekret an, das die Verwendung von Begriffen wie \u201eSteak\u201c oder \u201eWurst\u201c f\u00fcr pflanzliche Produkte verbot, selbst in Verbindung mit Zus\u00e4tzen wie \u201eGem\u00fcse\u201c oder \u201eSoja\u201c. Der franz\u00f6sische Staatsrat wandte sich daraufhin an den Gerichtshof, um Klarheit \u00fcber die Vereinbarkeit des Dekrets mit EU-Recht zu erhalten.<\/p>\n<p>Zu den wichtigsten Erkenntnissen des Urteils z\u00e4hlen:<\/p>\n<ul>\n<li><strong>Verbot aufgehoben<\/strong>: Der Gerichtshof entschied, dass die Mitgliedstaaten die Verwendung von Begriffen, die traditionell mit Erzeugnissen tierischen Ursprungs in Verbindung gebracht werden, zur Kennzeichnung von Erzeugnissen, die pflanzliche Proteine enthalten, nicht verbieten k\u00f6nnen.<\/li>\n<li><strong>Vollst\u00e4ndige Harmonisierung<\/strong>: Der Gerichtshof entschied, dass die vollst\u00e4ndige Harmonisierung gem\u00e4\u00df der EU-Verordnung (EU) Nr. 1169\/2011 die Mitgliedstaaten daran hindert, Schwellenwerte f\u00fcr den pflanzlichen Eiwei\u00dfgehalt festzulegen, die die Verwendung von Begriffen aus der Metzgerei- und Wurstwarenbranche f\u00fcr pflanzliche Eiwei\u00dflebensmittel einschr\u00e4nken.<\/li>\n<li><strong>Klarstellung der gesetzlichen Bezeichnungen<\/strong>: Zwar k\u00f6nnen die Mitgliedstaaten spezifische gesetzliche Bezeichnungen f\u00fcr bestimmte Lebensmittel festlegen, doch ein umfassendes Verbot der Verwendung bestimmter Begriffe f\u00fcr Lebensmittel mit bestimmten Eigenschaften ist mit dem EU-Recht unvereinbar, sofern die Bedingungen f\u00fcr die Verwendung dieser Bezeichnungen nicht ausdr\u00fccklich definiert sind.<\/li>\n<li><strong>Verbraucherschutz<\/strong>: Die Beh\u00f6rden haben weiterhin die M\u00f6glichkeit, die Verwendung bestimmter Namen anzufechten, wenn sie der Ansicht sind, dass diese Namen Verbraucher irref\u00fchren k\u00f6nnten.
