{"id":3337,"date":"2022-04-12T09:59:11","date_gmt":"2022-04-12T01:59:11","guid":{"rendered":"https:\/\/regask.com\/?p=3337"},"modified":"2024-10-16T02:57:07","modified_gmt":"2024-10-15T18:57:07","slug":"fda-nac-nest-pas-un-complement-alimentaire","status":"publish","type":"post","link":"https:\/\/regask.com\/fr\/fda-nac-not-dietary-supplement\/","title":{"rendered":"La FDA confirme que la NAC est exclue de la d\u00e9finition d&#039;un m\u00e9dicament\u2026"},"content":{"rendered":"<div><a href=\"https:\/\/www.fda.gov\/\" target=\"_blank\" rel=\"noopener\">La Food and Drug Administration (FDA) des \u00c9tats-Unis<\/a> a rejet\u00e9 la demande dans deux p\u00e9titions citoyennes, du Council for Responsible Nutrition (CRN) et de la Natural Products Association (NPA), demandant \u00e0 l&#039;agence de d\u00e9terminer que les produits contenant de la N-ac\u00e9tyl-L-cyst\u00e9ine (NAC) ne sont pas exclus de la d\u00e9finition d&#039;un compl\u00e9ment alimentaire en vertu de l&#039;article 201(ff)(3)(B)(i) de la loi f\u00e9d\u00e9rale sur les aliments, les m\u00e9dicaments et les cosm\u00e9tiques (FD&amp;C Act).<\/div>\n<div><\/div>\n<div>Bien que la r\u00e9ponse de la FDA aux p\u00e9titions citoyennes ait confirm\u00e9 que la NAC est exclue de la d\u00e9finition d&#039;un compl\u00e9ment alimentaire, l&#039;agence n&#039;a pas encore pris de d\u00e9cision sur la demande alternative de la p\u00e9tition citoyenne NPA, qui demandait que l&#039;agence entreprenne une r\u00e9glementation pour autoriser l&#039;utilisation de la NAC dans les compl\u00e9ments alimentaires. La FDA continue d&#039;examiner cette demande.<\/div>\n<div><\/div>\n<div>Entre-temps, compte tenu de l&#039;absence de probl\u00e8mes de s\u00e9curit\u00e9 sur la base de l&#039;examen de la FDA \u00e0 ce jour, entre autres facteurs, la FDA envisage d&#039;exercer son pouvoir discr\u00e9tionnaire d&#039;application de la loi pour les produits contenant de la NAC \u00e9tiquet\u00e9s comme compl\u00e9ments alimentaires qui seraient commercialis\u00e9s l\u00e9galement comme tels si la NAC n&#039;\u00e9tait pas exclue de la d\u00e9finition de compl\u00e9ment alimentaire et ne contrevenait pas par ailleurs \u00e0 la FD&amp;C Act.
