The vast majority of Europe\u2019s 500 million consumers use cosmetic and personal care products every day, says the association. Whether soap, shampoo, toothpaste, or perfumes and makeup, cosmetics is an important sector that provides significant employment in Europe. This has attracted many international investors and cosmetics companies, especially those from the United States, to enter the EU market.<\/p>\n<p>Europe is also one of the most advanced markets with a long history of regulation and enforcement on cosmetic production, <a href=\"https:\/\/regask.com\/regulatory-labeling-compliance-best-practices-in-fmcg-industry\/\">labeling<\/a> and advertising. Regulatory bodies in the EU have set out rules and a regulatory framework for market access, international trade relations, and regulatory convergence aiming to \u201censure the highest level of consumer safety while promoting the innovation and the competitiveness of this sector.<a href=\"#_edn2\" name=\"_ednref2\"><sup>[2]<\/sup><\/a>\u201d Hazardous substances or ingredients that may have an adverse effect on human health have been banned to be used in cosmetic products in the EU.<\/p>\n\t\t<\/div>\n\t\t\t\t\n<style>\n#col-694839760 > .col-inner {\n  margin: 0px 0px 20px 0px;\n}\n<\/style>\n\t<\/div>\n\n\t\n\n\n<\/div>\n<p>This makes it difficult for international companies, especially American companies, to sell cosmetic products in the region, because some cosmetic ingredients are banned in Europe but still being used in the US due to the different regulations in two regions. <strong>Compliance issues start to take hold and hinder the commercial success of US cosmetics companies that are trying to expand their presence in the EU. This article aims to provide insights for these companies by discussing the following topics: <\/strong><\/p>\n<ul>\n<li><strong>What is EU regulation on cosmetic ingredients? <\/strong><\/li>\n<li><strong>Which cosmetic ingredients are banned in the EU but not in the US? <\/strong><\/li>\n<li><strong>How does the regulatory difference affect US cosmetics companies? <\/strong><\/li>\n<li><strong>What should US cosmetics companies do to enter the EU market? <\/strong><\/li>\n<li><strong>Create a path-to-market strategy with <a href=\"https:\/\/regask.com\/our-solution\/#connect\">RegASK<\/a><\/strong><\/li>\n<\/ul>\n<h2 class=\"h4\">What is EU regulation on <strong>cosmetic ingredients<\/strong>?<\/h2>\n<p>The main regulatory framework for cosmetic products in the EU market is set out by Regulation (EC) No 1223\/2009<a href=\"#_edn3\" name=\"_ednref3\"><sup>[3]<\/sup><\/a>. It contains specific regulations on product safety, responsible persons and their obligations, product notification, allowed and prohibited cosmetic ingredients, among other topic areas<a href=\"#_edn4\" name=\"_ednref4\"><sup>[4]<\/sup><\/a>.<\/p>\n<p>There is a special database called CosIng, which allows companies to search for common ingredient names used for the labeling of cosmetic products<a href=\"#_edn5\" name=\"_ednref5\"><sup>[5]<\/sup><\/a>. Listing in the CosIng database does not automatically grant authorization of the ingredient to be used in cosmetic products. Cosmetic manufacturers are required<img loading=\"lazy\" decoding=\"async\" class=\"wp-image-2362 alignright\" src=\"https:\/\/regask.com\/wp-content\/uploads\/2021\/01\/Personal-Care-And-Cosmetic-Icon-330x330.png\" alt=\"Personal Care And Cosmetic Icon\" width=\"300\" height=\"300\" srcset=\"https:\/\/regask.com\/wp-content\/uploads\/2021\/01\/Personal-Care-And-Cosmetic-Icon-330x330.png 330w, https:\/\/regask.com\/wp-content\/uploads\/2021\/01\/Personal-Care-And-Cosmetic-Icon-130x130.png 130w, https:\/\/regask.com\/wp-content\/uploads\/2021\/01\/Personal-Care-And-Cosmetic-Icon-768x769.png 768w, https:\/\/regask.com\/wp-content\/uploads\/2021\/01\/Personal-Care-And-Cosmetic-Icon.png 834w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/> to\u00a0conduct a product safety assessment for the use of any ingredient in cosmetic products, to ensure that their products on the market are safe for human health and the environment<a href=\"#_edn6\" name=\"_ednref6\"><sup>[6]<\/sup><\/a>. Manufacturers are also required to submit their products\u2019 information via the EU cosmetic products notification portal (CPNP) prior to placing their products on the EU market<a href=\"#_edn7\" name=\"_ednref7\"><sup>[7]<\/sup><\/a>.<\/p>\n<p>These regulatory requirements, along with other applicable EU legislation ensure that all cosmetics on the market are safe and suitable for human use, and protect consumers from risks such as allergic reactions, skin sensitization, and toxicity.<\/p>\n<h2 class=\"h4\">Which cosmetic ingredients are <strong>banned in the EU but not in the US<\/strong>?<\/h2>\n<p>From cancer or heart disease to inflammatory bowel disease and asthma, many cases are being traced back to the cluster of conditions responsible for illnesses and deaths related to toxic chemicals. In the US, at least 64 people have died from acute exposure to methylene chloride since 1980, the ingredient has been used in aerosol cosmetic products (principally hair sprays)<a href=\"#_edn8\" name=\"_ednref8\"><sup>[8]<\/sup><\/a>.<\/p>\n<p>Both the US and the EU have their own regulatory system in place to govern the world of cosmetics. Although both systems impose restrictions, there are some differences between them. In this section, we try to shed light on the differences between the two regulatory systems, by diving into the list of cosmetic ingredients banned in the two regions.<\/p>\n<p>The Regulation (EC) No 1223\/2009 has banned over 1,600 ingredients for use in cosmetics, even though 80% of them have not been used and never would be used as cosmetic ingredients<a href=\"#_edn9\" name=\"_ednref9\"><sup>[9]<\/sup><\/a>. There are nine commonly used ingredients that are already banned in the EU due to high health risks but still allowed in the US:<\/p>\n<ol>\n<li>Formaldehyde<\/li>\n<li>Hydroquinone<\/li>\n<li>Triclosan<\/li>\n<li>Lead<\/li>\n<li>Parabens<\/li>\n<li>Petroleum Distillates<\/li>\n<li>Phthalates<\/li>\n<li>Selenium Sulfide<\/li>\n<li>Quaternium-15<\/li>\n<\/ol>\n<p>US FDA, however, only prohibits or restricts 11 ingredients that are harmful to human health<a href=\"#_edn10\" name=\"_ednref10\"><sup>[10]<\/sup><\/a>:<\/p>\n<ol>\n<li>Bithionol<\/li>\n<li>Chlorofluorocarbon propellants<\/li>\n<li>Chloroform<\/li>\n<li>Halogenated salicylanilides (di-, tri-, metabromsalan and tetrachlorosalicylanilide)<\/li>\n<li>Hexachlorophene<\/li>\n<li>Mercury compounds<\/li>\n<li>Methylene chloride<\/li>\n<li>Prohibited cattle materials<\/li>\n<li>Sunscreens in cosmetics (subject to product\u2019s labeling)<\/li>\n<li>Vinyl chloride<\/li>\n<li>Zirconium-containing complexes<\/li>\n<\/ol>\n<p>When it comes to the approval of chemicals used in cosmetics, the EU established the REACH regulation (Registration, Evaluation, Authorization and Restriction of Chemicals) which contains procedures for collecting and assessing information on the properties and hazards of substances. Manufacturers, importers and downstream users of chemicals are required to register their substances for hazard assessment by the European Chemicals Agency (ECHA). This is because US manufacturers will no longer be able to sell their products across Europe if they contain any of the ingredients prohibited by the European Commission.<\/p>\n<p>Second, there will be potential low demand for US cosmetics and personal care products among European consumers due to safety concerns. As consumers become more knowledgeable and cautious of what they purchase, they are also increasingly worried about the toxicity of the products they will consume. Some European consumers are likely to be skeptical about US brands due to the different regulatory regimes, even though there has been no evidence that American-produced cosmetics are unsafe.<\/p>\n<p>Following the low demand, US cosmetics companies will be forced to lower product prices and increase advertising expenditure, which will result in lower profits.<\/p>\n<p>The cost of compliance is also high for US manufacturers who are not familiar with these regulations. They will be subject to stringent safety reviews and tough penalties for violating these regulations.<\/p>\n<p>Another challenge faced by the US cosmetic industry is the difficulty to provide new and innovative products since they must refrain from using over 1,600 ingredients that are deemed illegal to use in cosmetics under EU law. This adds pressure to the R&amp;D process and slows down the launch of their new products, which could cause American beauty brands to be left behind in this competitive market.<\/p>\n<h2 class=\"h4\">What should US cosmetics companies do to <strong>enter the EU market<\/strong>?<\/h2>\n<p>European countries are very different from the US and other regions in the world, the marketing strategies that work well in the US may not work as well in the European market. What should US cosmetics manufacturers do if they want to enter the EU market? Here we recommend three key actions for US companies to succeed in entering the EU market.<\/p>\n<p><strong>1. Compliance is the key to success for the US cosmetic industry. <\/strong><\/p>\n<p>American beauty brands need to be aware of their legal obligations and ensure that they are <a href=\"https:\/\/regask.com\/an-easy-solution-to-effective-regulatory-monitoring\/\">monitoring and complying with all applicable laws<\/a> in the EU and each member state. Consequences of non-compliance for cosmetic products, other than damage to a manufacturer&#8217;s reputation and trustworthiness within the EU zone, can include: removal of the product from the EU market on a temporary\/permanent basis, refusal of free movement for the product with the EU zone, product recall, and in some scenarios a blanket ban on the product within Europe or even destruction of the product.<\/p>\n<p><strong>2.
