The Modernization of Cosmetics Regulation Act of 2022 (MoCRA), as it has been titled, has been included in the 4,155-page Omnibus government funding bill signed by president Biden on 29th December 2022.
The long-awaited legislation will advance product safety and innovation for the science-driven beauty and personal care industry and reinforce consumer confidence, according to PCPC (Personal Care Products Council).
While this is the first major amendment to the FDA’s cosmetics authorities since 1938, an FDA official told Congress in 2019, according to the Wall Street Journal “We believe that most cosmetics on the market in the United States are indeed safe, and in our experience, most firms are responsible actors—they care about consumer safety and the reputations of their brands, and in those rare cases when safety issues do arise, many firms work with us cooperatively to address them.”
Here are the mainly 7 implications of the Modernization Act for Cosmetics:
- Adverse events (Section 605): Under MoCRA, you must report adverse events and maintain records of adverse events. MoCRA requires that you accept reports of adverse events through your address, telephone number, or electronic contact information listed on your labels. When you receive an adverse event report, you must submit it to the FDA within 15 days. Any subsequent updates given to you within one year must also be reported within 15 days.
